Terms of Use

These Terms apply to the Site only. Purchases of Touch Hall hardware, software, installation and related services are governed by a separate written agreement, quote or order form between Touch Hall and the Customer. If those documents conflict with these Terms, the written agreement controls.

You must be at least 18 years old, or the age of majority where you live, to use the Site. If you use the Site on behalf of a school, district or other organization, you represent that you have authority to accept these Terms on its behalf.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal organizational purposes, such as researching and evaluating our products.

You agree not to:

• Use the Site in violation of any applicable law or regulation
• Copy, reproduce, republish or distribute Site content in bulk, or present it as your own
• Scrape, harvest or collect data from the Site by automated means, except for search engine indexing in accordance with our robots.txt file
• Attempt to gain unauthorized access to the Site, its servers or any connected systems, or interfere with its operation or security
• Upload or transmit viruses, malware or other harmful code
• Submit false, misleading or unlawful information through our forms, or impersonate any person or organization
• Use the Site to send spam or unsolicited communications

The Site and its content, including text, graphics, designs, illustrations, our name and logo, and the selection and arrangement of content, are owned by or licensed to Touch Hall and are protected by copyright, trademark and other intellectual property laws. Except for the limited license above, no rights are granted to you.

The Touch Hall name and logo are trademarks of Touch Hall. You may not use them without our prior written permission, except to refer accurately to our products.

We aim to keep product descriptions, specifications, timelines and features on the Site accurate and current, but they are provided for general information and planning purposes and may change without notice. They do not form part of any contract unless included in a signed agreement.

Screens, interfaces, schools, inductees, records and statistics shown on the Site are illustrative examples. Names and details used in those examples are fictional unless stated otherwise.

Our guides and articles, including content about accessibility, the Americans with Disabilities Act (ADA), WCAG and hall of fame programs, are provided for general educational purposes only. They are not legal, accessibility compliance or other professional advice. You should consult qualified professionals about your specific situation.

When you send us information through our contact form, by email or when booking a call, you confirm that it is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy.

If you give us ideas, suggestions or feedback about our products, you agree that we may use them without restriction or obligation to you.

The Site contains links to and integrations with third-party websites and services, such as Calendly for scheduling and FormSubmit for delivering form submissions. We do not control and are not responsible for third-party content, services or practices, and your use of them is governed by their own terms and policies.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS COMPLETE OR ACCURATE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, TOUCH HALL AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify and hold harmless Touch Hall and its affiliates, officers, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site, to the extent permitted by law.

These Terms are governed by the laws of the United States and of the state in which Touch Hall maintains its principal place of business, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in that state, and you consent to their jurisdiction.

Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days.

We may suspend or restrict your access to the Site at any time, without notice, if we believe you have violated these Terms or if needed to protect the Site or others. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification and governing law.

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

We may revise these Terms from time to time. The "Last updated" date at the top of this page shows when they were last changed. Changes take effect when posted, and your continued use of the Site means you accept the revised Terms.
